Who is Responsible for Ordering the U&O Inspection?

Once the property goes Under Agreement, typically the seller will file an application with the municipality and schedule the inspection. Since these are municipal requirements, the seller will also be responsible for any requested repairs. It’s best to start this process early to prevent delays with settlement.

Certain outlying circumstances put the responsibility on the buyer to obtain the U&O certificate. For instance, if there is an estate sale, a bank sale, or a property being sold as-is, the seller is putting the responsibility on the buyer. However, that’s usually disclosed on the MLS. It’s important to check with your agent to see who will assume the responsibility, but it is the seller in most cases.
